Landlord Liable?

A couple of weeks ago my wife and I awoke to a bat flying around in our apartment.  I was unable to catch the bat to have it tested for rabies.  So the next day we contacted some doctors and since we were asleep we could have no guarantee that we hadn’t been bitten while most likely we weren’t, but if we didn’t get vaccinated for rabies there was a chance that bat had rabies and had bitten one of us.  I consulted 3 doctors and even came across a recommendation to get vaccinated from the Center for Disease control.  My wife and I have run up about 2500 total in medical bills and we’re thinking for taking our landlord to court(his insurance won’t cover anything).  I was curious if you guys thought we had a decent case?  Its noted that we have had bat problems in our apartment and common areas ever since the day we moved in.  We have had 3 in 10 months in our apartment and dealt with another 4 in the common areas.  Each time we complained to the landlord.  Outside of looking around for holes they did nothing.  They sought no professional help, made no attempts to further prevent this from happening again.  A little over two weeks before we had awoken to our third bat in our apartment I had seen another one while trying to do laundry in our basement.  I had called and complained again and she told me they were “looking into it” which in their speak means doing nothing.  We contend that we should have never been put into this position and if the landlord had responded even remotely to any of our previous complaints the problem could have been avoided.  Any opinions on the situation?

hello sir,

One of the reasons landlords are reluctant to rent to tenants with pets is that in some circumstances, a landlord may be financially responsible for damage or injury caused by a tenant’s dog. In other words, if the injured person sues the landlord, the landlord, as well as the dog’s owner, may end up paying. Tenants must be prepared to deal with the landlord’s fear of liability.
