We moved into a upper-scale ($1100/month) condominium complex last fall (2009). The unit was destroyed by previous tenants, i.e., broken/smashed/missing doors, electrical fixtures burnt out, windows broken, destroyed carpeting, et. al.  At the time we moved in, the landlord guaranteed...IN WRITING...unit would be repaired and “be a nice as the original unit shown.” Almost 1 year later, NOTHING has been repaired or replaced.

Neighborhood threatened to file complaint with the city regarding the lack of upkeep to the property. Again, this is a very upscale neighborhood and pride in ownership prevails with each independently owned building, except the one we reside in.

From day one, our rent was paid not only in full and on time but typically 1 week to 10 days before it was due.  Due to medical leave/job layoff, fell behind in rent (1/2 month in April, $100 for May); he served 5 day notice. Presented terms to him, in writing, which he AGREED to, also in writing.  We have been completely compliant with the terms.  The final payment is not due until mid-August, yet he harasses us via email on a daily basis. “ Did you send another check out yet??” Now he is accusing us that we did not pay the security deposit, which we did and have records showing payment. 

Each time we have called him we get, “I’m on my way out! Can’t talk now, but I’ll stop by sometime next week.” That has never happened.  Entire building is deteriorating. He has not physically been on property for over 9 months (lives out of city). He will only communicate via email. Each of his emails have become more threatening in nature, “I’ll ruin your credit! No one will rent to you again when they see an eviction notice on your credit bureau”...and on and on.

Moving is not an option.  We will not nor can we afford to break the lease.  He has 2 other empty units, probably in comparable condition to ours, which is why the remain unrented.  It’s obvious that he’s needing money as the loss of rental income is no doubt cramping his playboy, jet-setter lifestyle.  One would think he would work with tenants such as us who planned on being long-term residents, but through no fault of our own, fell behind in rent.  We continue to show a good faith effort , per written agreement, in becoming current with the arrears.  Yet the threats continue.

Looks like we’ll have to take money for that final installment in August put it towards legal fees, not unless someone has a better idea for an amicable resolution.
