I own a home in Sandwich, IL that I have been renting out to my tenants (Brian and Tammy Russell) for $1,800 for the past 3 Â½ years. At the end of August 2011, I received a phone call from these tenants stating that they were no longer going to pay. Once a physical visit was made shortly thereafter, they agreed to continue to pay the agreed amount until contract expiration of 2/29/2012. In October, November, and December 2011 these tenants have only paid $1,200. I as a result, started to default on my mortgage with my servicer as my income had dropped. Once it became apparent that these tenants were not going to pay to make their contract current, I started the process of working with my bank to qualify for the deed in lieu of foreclosure. The bank sent some documentation to 905 Bainbridge Ct. and the tenants called me on Tuesday, January 3rd 2012 stating, â€œWe are not going to pay this month (January) or next month (February) and we will be out of the house March 1st. If you have any questions â€“ call our attorney. So I called the attorney and he was full of nonsense. I hired my own attorney and on February 21st 2012 both defendants and I testified before the Dekalb County judge regarding the due rental amount in addition to attorney/late fees and court costs. Judge Klein ruled in my favor stating to the defendants that they cannot simply occupy a property rent free. I have wasted a lot of money, time, and resources to fight these tenants
Here is my wifeâ€™s final letter to our former tenants. The comments are 100% true. â€“ PLEASE BE AWARE OF THESE â€œCHRISTIANâ€ PEOPLE.
Brian and Tammy,
I am writing this to you because I canâ€™t contain my anger when I try and talk to you in person. I am shocked and appalled at the way you both have treated Phil and me after all we have done for you. To remind you of how the last 3 and Â½ years went:
You had a foreclosure. We looked the other way about your bad credit and assumed you had gotten down on your luck. We didnâ€™t even run a credit check on you which is why you were able to move in with us. No other location would have done that for you. The economy was just starting to tank and a foreclosure was a super bad thing.
The very first issue with you was that you couldnâ€™t pay your security deposit. We let you pay $200 a month until it was paid off and then you were supposed to continue to pay me $200 as a guarantee that you were purchasing the home. You played â€œconfusedâ€ and we let it go because we were scared to have you leave.
â€œWe have every intention of purchasing your homeâ€. A bunch a smoke you were blowing so you could stay in my home. You screwed me out of being able to sell my home 4 separate times and every time we got close to the end of your lease I would receive a crying phone call from Tammy about how she was unable to show the house and you had nowhere to go.
I lived in a 600 sqft apartment so I could afford to cover your extras on my mortgage. I lived in a 600sqft apartment and gave birth and lived in that tiny hole without a nursery so you could live in my home and I could float you for another year.
I put off having a baby because we couldnâ€™t figure out what you were up to. I held off on the most important thing in my life for you. It makes me want to throw up.
We returned your $1500 deposit to â€œhelp you pay off your debtâ€ and be able to purchase our home which you had â€œevery intentionâ€ of doing. No other landlord would do that and I am a fool for doing so. You donâ€™t deserve my help.
We also gave you a Â½ monthâ€™s rent off to help with your Christmas bills. Again, no other landlord would do that and I am a fool for doing so.
You gave us attitude because we wouldnâ€™t let you install a screen door. You donâ€™t own my house and I guess my instinct was correct that you never would.
You put up a pool and make me waste time going back and forth between you and the association, when you knew full well you couldnâ€™t.
You call me and say you arenâ€™t paying anymore because I am foreclosing and you need money to move into a new place. Please be aware that you are the ONLY reason I am foreclosing. You know I just purchased a home and am stretched thin to cover your mortgage and my own. You have some nerve to call me and say you arenâ€™t paying and to call your attorney. How dare you hire an attorney to come after me, the person who has given you a place to live and worked with you when no one else would.
Your lease was up March 1st. If we werenâ€™t foreclosing, you would have had to figure out a way to pay for a new place. I am sure you would have thought up a way to try and talk me into letting you go the last month anyway. You screwed my husbandâ€™s credit up because you are a failure and canâ€™t handle your bills. If you canâ€™t afford to live somewhere, move on, like 2 years ago, instead of mooching off me and my stupidity for thinking the best of you. As I am writing this, all I realize is that I lost thousands of dollars, days of my life because it was spent talking about you and you received a clean home with landlords that really cared and wanted you to succeed.
I could really care less where you go from here as long as I never have to speak to you again. I hope your new landlord has some brains about them and at least checked your credit. Also, stop lying about me on Facebook. It is childish and slanderous. I am not foreclosing on you and putting your stuff on the curb one day when you are not home. First you would have to have a job and second, the foreclosure hasnâ€™t even started yet. You are getting kicked out because instead of finishing this relationship off on a good note, you tried to get greedy and take my money. I told you not to mess with my family and this was uncalled for.
It is your call if you want to accept the terms we gave you or go to court. I donâ€™t care either way. I want this to end and you to disappear from my life forever. I hope you know in your heart what bad Christians you have been and that lying to make yourselves look like victims isnâ€™t good in the eyes of GOD.
